Distance Sales Agreement

1. Subject of the Agreement

The subject of this agreement is to define the rights and obligations of the parties concerning the sale and delivery of the product(s), whose qualities and sales price are stated below, ordered electronically by the BUYER from the internet site www.goscontrols.com (“Website”), in accordance with the provisions of the Estonian Law of Obligations Act (VÕS), the Consumer Protection Act, and relevant EU consumer protection directives.

3. Buyer Information

The BUYER is any natural or legal person who purchases goods or services through the Website. (Hereinafter referred to as “BUYER” or “Customer”).

4. Subject and Product Information

The type, quantity, brand/model, color, number, sales price, and payment method of the goods/products or services are as stated on the Website at the time of order. The SELLER reserves the right to update such information without prior notice.

5. General Provisions

5.1. The BUYER declares that they have read and understood the preliminary information regarding the product(s), including total price (with taxes), payment method, delivery, and delivery costs, and confirms this electronically.

5.2. The SELLER is not liable for damages caused by the use of the Website or its services, except where liability is mandatory under Estonian law.

5.3. The SELLER may change, reorganize, or suspend any services, products, terms of use, or information on the Website without prior notice.

5.4. Links to third-party websites may appear on the Website. The SELLER is not responsible for the content of these external sites.

5.5. All intellectual property rights related to the Website (including design, trademarks, logos, domain, software, content, and business model) belong to the SELLER or are licensed to it and are protected by the Estonian Copyright Act and EU law. Unauthorized use is prohibited.

5.6. The BUYER’s personal data may be disclosed to competent Estonian authorities if required by law.

5.7. The SELLER will deliver the ordered product(s) to the BUYER within 30 days from the order date, unless otherwise agreed. Delivery is carried out through the SELLER’s contracted shipping company (currently FedEx).

5.8. If delivery is refused by a person other than the BUYER (when designated as recipient), the SELLER cannot be held liable.

5.9. The SELLER is not responsible for damages or delays caused by the shipping company.

5.10. The SELLER is responsible for delivering the products in conformity with the order, in sound condition, and with any applicable warranty documents or manuals.

5.11. If the SELLER cannot fulfill the order, it will inform the BUYER and may provide a substitute product of equal value, subject to the BUYER’s consent.

5.12. If the BUYER’s payment method is used unlawfully by third parties (e.g., fraudulent card use) and the SELLER does not receive payment, the BUYER must return the delivered product(s) within 3 days.

5.13. If the product is unavailable in stock and no substitute is available, the SELLER may refund the BUYER.

5.14. In case of force majeure (e.g., extreme weather, transport disruption), the SELLER will notify the BUYER. The BUYER may cancel the order, and any payments will be refunded within 14 days.

5.15. Refunds will be processed within 14 days after cancellation. Delays in bank processing are outside the SELLER’s control.

5.16. The SELLER reserves the right to limit or cancel bulk purchases exceeding retail needs (typically more than 10 units).

5.17. If payment verification fails, the SELLER may request identity documents from the BUYER. If not provided, the SELLER may cancel the order without liability.

5.18. If product prices are clearly erroneous (e.g., far below market price due to technical error), the SELLER may cancel the order. The BUYER accepts this condition.

6. Right of Withdrawal

The BUYER has the right to withdraw from the agreement within 14 days of receiving the goods, without giving any reason, in accordance with the Law of Obligations Act and EU Directive 2011/83/EU.
To exercise this right, the BUYER must notify the SELLER by email (sales@goscontrols.com) or phone (+44 7878 758055).
The BUYER must return the goods within 14 days after giving notice of withdrawal. The BUYER bears the cost of return shipping, unless otherwise agreed.
The right of withdrawal does not apply to:
- Custom-made or personalized products,
- Products not suitable for return due to their nature,
- Goods that deteriorate quickly or expire.

7. Effective Date and Term

This agreement is concluded electronically at the time of the BUYER’s order confirmation and remains valid until both parties fulfill their obligations.

8. Governing Law and Jurisdiction

This agreement is governed by the laws of Estonia.
In case of disputes, the BUYER may contact the Estonian Consumer Protection and Technical Regulatory Authority (TTJA).
If disputes cannot be resolved amicably, jurisdiction lies with the Harju County Court (Tallinn), unless otherwise required by mandatory consumer protection law.
